It doesn't reproduce on my side. I saved a file with the contents

#+BEGIN_EXPORT latex \(a\) #+END_EXPORT
#+BEGIN_EXPORT latex \[
a
\] #+END_EXPORT
----------------------------------------------------------------------
and evaluated (texmathp) by M-: at each position before "a". Both
returned t for me.
