I managed to reproduce the problem and I have written two tests that both fail 
using .timestamp and .modified as mentioned above:

1. interrupt response
  - expect timestamp of partially download file to match timestamp on server 
after fail
2. resume interrupted response with existing file that has more recent timestamp
  - expect existing file to be appended to despite timestamp OR
  - ignore as the file could have changed locally OR
  - do a limited sample of data in local file - append only on match
