consistent legend size, interactive vs batch

Hi,
i am having trouble to reproduce an appropriate sizing of the elements and
the box of the plot legends.
Using the legend command within scripts consistently produces too large
legend boxes and too large spacings between legend entries. However if i
type the commands within an interactive prompt (even with --norc) of octave
i get better results
This is surprising and frustrating because i want to get consistent results
between scripts and interactive sessions and I want to rely on scripts to
produce consistent plots. Is this a known issue or did i just miss an
command line option?
My setup:
octave 4.2.0 ("x86_64-pc-linux-gnu")
FLTK set as graphics toolkit
See the attachment for the script and the PDF output
