The attached patch fixes it:
On most unix-like systems, it is done with the patch command. If you are in the directory where legend.m is located, then
patch -p2 <octave-forge-2006.07.09-legend.patchshould do it. If you run into problems, for a small patch like this, it is pretty easy to just hand edit the file if necessary, where you remove the lines that begin with - and add the lines beginning with +.
