I successfully compiled both octave 2.9.6 and 2.9.7 with the patch in
http://www.cae.wisc.edu/pipermail/bug-octave/2006-August/000613.html
using gcc-3.2-3 under cygwin (I used this gcc version to circumvent the nasty 
slowdown due to the sjlj-exception handling issue) 
however I did not run yet make check, just the build process completed 
successfully and the executables run.

I also tried gcc-4.1.1 once on (I believe) octave 2.1.73, but did not get a 
running executable. But I did not delve into why not. Perhaps the same reason 
as to why the gcc-3.4.4 build fails yielding running executables?

Do you get the same error message in compilation with gcc-3.3.3 as mentioned in 
the above link?
