Consultation on the Advisory Council on Intellectual Property’s (ACIP)
recommendation on the innovation patent system



This email is to provide you with an update on recent progress in
relation to the Advisory Council on Intellectual Property’s (ACIP)
Review of the Innovation Patent System. You are receiving this as you
previously expressed an interest in prior reviews of the innovation
patent system.



On 16 June 2014 ACIP released their Final Report. At that time they were
unable to make a recommendation supporting the retention or abolition of
the innovation patent system due to a lack of empirical evidence. Since
then, more information has become available and IP Australia has
undertaken a comprehensive economic analysis of the economic impact of
the innovation patent system. ACIP has considered this new research and
released a statement

updating their recommendation. They now consider that the Government
should consider abolishing the innovation patent system.



IP Australia has now released a Consultation
Paper<http://www.ipaustralia.gov.au/about-us/public-consultations/Consultation-on-the-ACIP-recommendation-on-the-innovation-patent-system/>
seeking stakeholder views on ACIP’s revised recommendation the
Government should consider abolishing the innovation patent system.



The Paper seeks views from interested stakeholders on:

·       ACIP’s revised recommendation; and

·       Any alternate suggestions to encourage innovation amongst small
to medium enterprises (SMEs).
