Follow-up Comment #1:
Thank you for the bug report, but it looks to me like the change you propose
doesn't change the results at all, it is only intended to avoid the warning
message, is that right? If so, this change isn't necessary and makes the code
more complex for no gain.
Assuming that's true, in Octave version 5 and earlier you can simply disable
the warning if you find it annoying.

In Octave version 6, this warning has been removed completely.
