What Eluze wants to say is
a) you can't do this with a tie but you have to use a slur instead
b) musically it is probably one voice.
I can't judge from the small example if this is a real four-part polyphony.
If yes I would think that the bes4 from the lower staff is continued with the a'4. in the upper staff.
So the voice 'starting' with e'8 is just temporarily in the upper staff.
