Isn't it possible to ensure that the vertical start or end distances  
(measured from the staff center) of a phrasing slur at a given moment is  
strictly larger than that of a slur (or a tie)?

Or perhaps: Always ensure that a slur is positioned before a phrasing slur  
(and a tie before a slur).
