It was written by *Lockheed-Martin* employees under contract to US
DoE.  Yes, most likely US taxpayers paid the full costs (and a
premium, national labs man hours ain't cheap) on the development of
this software, but it was not done by civil servants, so it is not "a
work of the US government" (and thus exempt from copyright).

DE-AC04-94AL85000 with the United States Department of Energy"

If you are a US taxpayer you should write your congress-critter if you
think that DoE should negotiate better terms for the release of
software written under their contracts.
