    Was the "affected" person unaware of the possibility to create an open 
    source project under his favorite license (apparently, GPL) under the
    auspices of sf.net or berlios.de or some other hosting provider ?

I am not a supporter of open source and never was, but it is true that
these and other sites do make it possible to host free software under
a range of licenses, not limited the two BSD licenses.

It would be interesting to ask why he did not move his software away,
and whether he considered it.  Probably bad advice and ignorance
played a role.

But that does not mean that what Mathworks did was not harmful.  If
Mathworks tried to push people in a certain direction, and succeeded,
it is responsible for having done so.  The fact that they had a way to
resist going where Mathworks wanted to push them does mean they share
the responsibility, but it does not make Mathworks blameless.
