Bug in patch version 2.5.9

When using -p0 mode it appears to break if you have files with ~'s at the end 
of the name, as with backup files generated by jed. running in -p1 mode will 
patch fine, but prompt for 'missing file' when run in -p0 mode.

If the problem can't be recreated I can probably generate a buggy patch if 
needed.
