Thanks for the report.
That's fixed in 4.1.2.

  * cp no longer fails when two or more source files are the same;
      now it just gives a warning and doesn't copy the file the second time.
      E.g., cp a a d/ produces this:
      cp: warning: source file `a' specified more than once
