I'm not sure this is only a cygwin issue.If you're editing/viewing the log files created during the test, some notepad editors (eg. notepad, notepad++) might lock the files or directories (especially with notepad++ when file is changed) In that case 'make check' will fail because it's not the shell preventing 'rm' to work but the notepad editor.
Just thought it was worth mentioning before applying a patch. Julien
